1. General provisions
The CORONA-TEST.BE e-commerce website offers its customers the opportunity to purchase DeepBlue and New Gene self-test kits online.
These General Terms and Conditions (“Conditions”) apply to every order placed by a visitor to this e-commerce website (“Customer”). When placing an order through the CORONA-TEST.BE webshop, the Customer must explicitly accept these Terms and Conditions, thereby agreeing to the applicability of these Terms and Conditions to the exclusion of any other terms and conditions. Additional terms and conditions of the Customer are excluded, unless they have been previously, in writing and expressly accepted by CORONA-TEST.BE.
2. Price
All prices stated are in euros and always not including VAT and all other duties or taxes that the Customer is obliged to pay.
If delivery, reservation or administrative costs are charged, this will be stated separately.
The price stated refers exclusively to the articles as described verbatim. The accompanying photos are for decorative purposes only and may contain elements that are not included in the price.
3. Offer
Obvious mistakes or errors in the offer are not binding to CORONA-TEST.BE. CORONA-TEST.BE is only bound to a best efforts obligation as to the correctness and completeness of the information offered. CORONA-TEST.BE is in no way responsible for obvious material errors, typographical or printing errors or colour differences.
If the Customer has specific questions about e.g. sizes, colour, availability, delivery period or delivery method, he is requested to contact us in advance.
The offer is valid while stocks last and can, including the price, be modified or withdrawn by CORONA-TEST.BE at any time and without any prior notification to the Customer. CORONA-TEST.BE cannot be held responsible for the unavailability of a product. If an offer has a limited period of validity or is subject to conditions, this will be expressly stated in the offer.
4. Online purchases
CORONA-TEST.BE will send the Customer invoices for the services and products it has provided or will provide at the e-mail address indicated by the Customer.
The customer must pay the amounts due, including VAT, immediately, unless otherwise agreed in writing.
When CORONA-TEST.BE is not in a position to deliver the goods due to exhaustion of stock, force majeure, strike, lock-down, etc… CORONA-TEST.BE is not able to execute the agreement, it can terminate the agreement without the customer being able to claim any compensation.
CORONA-TEST.BE does not guarantee that the use of the website by the Customer will be uninterrupted, secure or error-free. CORONA-TEST.BE is in no way liable for this.
The customer agrees to provide CORONA-TEST.BE with full and correct details of the purchase and account information relating to a purchase of one of the CORONA-TEST.BE products or items.
5. Delivery and performance of the Agreement
Articles or products ordered via this web shop will be delivered by CORONA-TEST.BE to the address given by the Customer.
The risk of loss or damage will pass to the Customer as soon as he (or a third party appointed by him) has taken physical possession of the goods.
CORONA-TEST.BE must be informed of any visible defects within 24 hours by e-mail or by registered post under penalty of cancellation.
CORONA-TEST.BE must be informed of any hidden defects within 8 days after their discovery, by e-mail or by post under penalty of cancellation.
In the case of a CORONA-TEST.BE-liable defect and if the above-mentioned formalities have been fulfilled, the obligation of CORONA-TEST.BE will be limited to the repair of the defect and, if the defect is not reasonably repairable, to the replacement of the goods by an identical or similar good. CORONA-TEST.BE will never be obliged to pay any other form of compensation, neither for direct nor for indirect damage.
CORONA-TEST.BE cannot be held responsible for the use of the product by the Customer. CORONA-TEST.BE refers to the enclosed information leaflet.
6. Penalty for non-compliance with conditions
A breach or non-compliance of the Conditions by the Customer may result in an immediate termination of the services of CORONA-TEST.BE.
7. Privacy
If, as part of the performance of the contract, personal data of employees or appointees of CORONA-TEST.BE are communicated (name, contact details, position), the Customer undertakes to process these data only in accordance with the Belgian law of 30 July 2018 on the protection of natural persons with regard to the processing of personal data and the European Regulation 2016/679 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data. The data may only be used for the performance of the contract between CORONA-TEST.BE and the Customer.
8. Validity impairment – non-abandonment
If any provision of these Conditions is declared invalid, illegal or null and void, this will in no way affect the validity, legality and applicability of the other provisions.
The failure at any time by CORONA-TEST.BE to enforce any of the rights enumerated in these Conditions, or to exercise any of them, will never be seen as a waiver of such provision and will never affect the validity of these rights.
9. Proof
The Customer accepts that electronic communications and backups may serve as evidence.
10. Intellectual property rights
All copyrights and other intellectual property rights of its website https://corona-test.be belong to CORONA-TEST.BE. Nothing on this website may be made public or reproduced without the express written permission of CORONA-TEST.BE.
Unless otherwise agreed, all texts, diagrams, drawings, illustrations, designs, films, photographs, audio and audio-visual recordings and other materials or (electronic) files produced by CORONA-TEST.BE within the framework of the order will remain fully the property of CORONA-TEST.BE, irrespective of whether these are made available to the Customer or to third parties.
11. Applicable law – Competent court
This agreement is governed by Belgian law. Any disputes shall be submitted to the courts of the district of Antwerp, Antwerp section.
